Welcome to TeachQuest! These Terms of Use ("Terms") govern your use of our website and services (collectively, "Services"). By accessing or using TeachQuest, you agree to be bound by these Terms. If you disagree with any part, do not use our Services.

1. Acceptance of Terms

By accessing TeachQuest, you accept and agree to be bound by these Terms as well as any posted guidelines or rules that apply to specific features. Any participation in the platform constitutes acceptance of this agreement.

2. Description of Service

TeachQuest is an educational RPG classroom management platform designed for teachers to gamify instruction. Teachers can create virtual classrooms, manage student characters, build educational content, and engage learners through quests, raids, spells, rewards, and more.

3. User Accounts and Responsibilities

3.1. Teacher Accounts

  • Provide accurate, current, and complete information during registration.
  • Maintain the confidentiality of account credentials.
  • Accept responsibility for all activities conducted under the account.
  • Notify us immediately of any unauthorized use.
  • Obtain necessary parent or guardian consent for student participation as required by school policy and applicable laws.

3.2. Student Accounts

  • Student accounts are created and managed by teachers.
  • Students use the credentials provided by their teacher.
  • Students must keep login information confidential.
  • Credentials may not be shared with others.

3.3. Parent Access

  • Parents can view their child's progress using a unique student code from the teacher.
  • Parent access is read-only and does not require full account creation.
  • Parents must use any shared information responsibly and in accordance with these Terms.

4. Acceptable Use Policy

You agree not to use TeachQuest to:

  • Violate any applicable laws or regulations.
  • Infringe upon the rights of others.
  • Upload or transmit unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, or otherwise objectionable content.
  • Impersonate any person or entity or misrepresent your affiliation.
  • Attempt to gain unauthorized access to any part of the Services or connected systems.
  • Interfere with or disrupt the Services or the servers and networks that support them.
  • Use the Services for commercial purposes without express written consent.
  • Collect or store personal data about other users without consent.
  • Create content that promotes violence, discrimination, or illegal activity.

5. Content and Intellectual Property

5.1. Our Content

The Services and their original content, features, and functionality are the exclusive property of TeachQuest and its licensors. They are protected by copyright, trademark, and other laws.

5.2. User-Generated Content

  • Teachers may create custom content such as quests, spells, and attacks.
  • You retain ownership of the content you create but grant us a license to store and display it to deliver the Services.
  • You are responsible for ensuring you have the right to use any content you upload or create.
  • We may remove content that violates these Terms or is otherwise objectionable.

6. Privacy and Data Protection

Your privacy matters to us. Collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Service Availability and Modifications

  • We strive for reliable service but cannot guarantee uninterrupted access.
  • We may modify, suspend, or discontinue any part of the Services at any time.

12. Termination

We may terminate or suspend your account and bar access to the Services immediately, without prior notice, for any reason including breach of these Terms.

If you wish to terminate your account, you may discontinue using TeachQuest or contact us to delete your account and associated data.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which TeachQuest operates, without regard to conflict of law provisions. Failure to enforce any provision does not constitute a waiver.

14. Changes to Terms

We may modify or replace these Terms at any time. If a revision is material, we will attempt to provide at least 30 days' notice before new terms take effect.

By continuing to access or use TeachQuest after revisions become effective, you agree to be bound by the updated Terms. If you do not agree, discontinue use of the Services.

15. Severability

If any provision of these Terms is held unenforceable or invalid, the remaining provisions will continue in full force, and the invalid provision will be interpreted to best accomplish its original intent.
